Immigrant Visa Requirements

  • If you are an employer who employs a foreign worker in an executive or managerial capacity on an L-1A intracompany transfer visa, you may directly sponsor the employee for an immigrant visa. We will be happy to assist you in filing this application with the United States Citizenship and Immigration Service (USCIS).
  • If you, in your capacity as an employer, presently have a foreign worker employed by your company on an H, TN, O, or L-1B work visa, or other non-immigrant visa, your business can sponsor him or her for a green card (permanent residence or immigrant visa). You must establish that your business has been unable to find an American worker to hire who meets reasonable job requirements, including minimum education and experience requirements.

PERM Labor Certification

In most cases, prior to filing an employment-based immigrant visa application on the employee's behalf, employers must receive approval of a Program Electronic Review Management (PERM) labor certification. This application is filed on behalf of the sponsored or potential employee. As of March 2005, the PERM labor certification process has replaced the traditional Recruitment or Reduction in Recruitment (RIR) process, and is now the primary process for allowing businesses to sponsor employees to receive green cards.
